關于進一步推進寧波市建設工程綜合保險工作的通知

各區縣(市)、開發(fa)園區住(zhu)房城鄉建設、金融工作、發(fa)展改革、公共(gong)資源交易行政主管部門:

自(zi)《關于開展(zhan)(zhan)建(jian)(jian)(jian)設(she)工(gong)程(cheng)綜(zong)合保(bao)(bao)險(xian)試(shi)(shi)點工(gong)作(zuo)的(de)通(tong)知》(甬金辦〔2015〕51號(hao))發(fa)布(bu)以來,為期三年的(de)建(jian)(jian)(jian)設(she)工(gong)程(cheng)綜(zong)合保(bao)(bao)險(xian)試(shi)(shi)點工(gong)作(zuo)已經結束,對(dui)促進(jin)(jin)我(wo)市建(jian)(jian)(jian)筑行業(ye)(ye)的(de)改(gai)革發(fa)展(zhan)(zhan),進(jin)(jin)一步(bu)完善建(jian)(jian)(jian)設(she)工(gong)程(cheng)擔保(bao)(bao)制度(du),推進(jin)(jin)建(jian)(jian)(jian)筑業(ye)(ye)降(jiang)本減負,推動寧(ning)波保(bao)(bao)險(xian)創新試(shi)(shi)驗區建(jian)(jian)(jian)設(she)發(fa)揮了(le)積(ji)極作(zuo)用,取得了(le)預期成效(xiao)。為深(shen)入貫徹落實(shi)《國(guo)務(wu)院辦公廳促進(jin)(jin)建(jian)(jian)(jian)筑業(ye)(ye)持續(xu)健(jian)康發(fa)展(zhan)(zhan)的(de)意見》(國(guo)辦發(fa)〔2017〕19號(hao))、《國(guo)務(wu)院辦公廳關于開展(zhan)(zhan)工(gong)程(cheng)建(jian)(jian)(jian)設(she)項目審批制度(du)改(gai)革試(shi)(shi)點的(de)通(tong)知》(國(guo)辦發(fa)〔2018〕33號(hao))等文件精神,進(jin)(jin)一步(bu)優(you)化(hua)我(wo)市營商環境,強化(hua)事(shi)(shi)中事(shi)(shi)后監(jian)管,保(bao)(bao)障工(gong)程(cheng)建(jian)(jian)(jian)設(she)各方主體(ti)的(de)合法權益,經研究,決定(ding)正式實(shi)施(shi)并全面(mian)推進(jin)(jin)建(jian)(jian)(jian)設(she)工(gong)程(cheng)綜(zong)合保(bao)(bao)險(xian)工(gong)作(zuo)。現將有(you)關事(shi)(shi)項通(tong)知如下:

一、推(tui)進(jin)建設工程(cheng)綜合(he)保險擴面提質(zhi)

建設(she)工(gong)(gong)程綜合保險包括投標(biao)保證、履約保證、工(gong)(gong)程款支付保證、工(gong)(gong)程質量保證、農民工(gong)(gong)工(gong)(gong)資支付保證等五個基礎性險種,并根據需要(yao)逐(zhu)步增加新(xin)的險種。相關保額和期限按(an)照《寧波市(shi)房屋建筑(zhu)和市(shi)政(zheng)基礎設(she)施工(gong)(gong)程擔保管(guan)理辦(ban)法(試(shi)行)》等文(wen)件執行。

(一)全面推(tui)進保(bao)(bao)(bao)險(xian)服務領域全覆(fu)蓋。推(tui)動建(jian)設工(gong)(gong)程(cheng)(cheng)綜合保(bao)(bao)(bao)險(xian)服務范(fan)圍從中心城區(qu)向(xiang)各(ge)(ge)區(qu)縣(市(shi))延伸,實(shi)現(xian)各(ge)(ge)險(xian)種同步推(tui)進、平(ping)衡(heng)發展,并實(shi)現(xian)全市(shi)全覆(fu)蓋。允(yun)許(xu)各(ge)(ge)類工(gong)(gong)程(cheng)(cheng)擔保(bao)(bao)(bao)采(cai)用保(bao)(bao)(bao)險(xian)等方(fang)式進行(xing)擔保(bao)(bao)(bao),相關單位不得無故拒絕(jue)。建(jian)設工(gong)(gong)程(cheng)(cheng)綜合保(bao)(bao)(bao)險(xian)保(bao)(bao)(bao)費(fei)可在建(jian)設工(gong)(gong)程(cheng)(cheng)成本(ben)中列支(zhi)。

(二)大力推行“保(bao)(bao)險+服務(wu)”。要打破傳統業務(wu)模式,將建(jian)(jian)設工程(cheng)綜合(he)(he)保(bao)(bao)險與互聯(lian)(lian)網(wang)相結合(he)(he),施行“一站式”保(bao)(bao)險服務(wu),實現投保(bao)(bao)流程(cheng)數字化、互聯(lian)(lian)網(wang)化,逐步(bu)推行電子保(bao)(bao)單(dan)。進(jin)一步(bu)簡化投保(bao)(bao)流程(cheng)和保(bao)(bao)單(dan)驗真方(fang)(fang)(fang)式,鼓(gu)勵保(bao)(bao)險機構(gou)(gou)與專業第三(san)方(fang)(fang)(fang)平(ping)(ping)臺(tai)機構(gou)(gou)合(he)(he)作,借助第三(san)方(fang)(fang)(fang)專業能力提升(sheng)保(bao)(bao)險服務(wu)效能,為行政主管(guan)部門實時監(jian)管(guan)、查詢統計提供數據化服務(wu)平(ping)(ping)臺(tai),為建(jian)(jian)筑企業網(wang)上投保(bao)(bao)、查詢、理賠提供便利。相關行政主管(guan)部門要與保(bao)(bao)險機構(gou)(gou)、第三(san)方(fang)(fang)(fang)平(ping)(ping)臺(tai)機構(gou)(gou)實現數據共享、信(xin)息互聯(lian)(lian),共同(tong)推進(jin)建(jian)(jian)設工程(cheng)綜合(he)(he)保(bao)(bao)險信(xin)息化建(jian)(jian)設。

(三(san))提升(sheng)(sheng)保(bao)(bao)(bao)險(xian)(xian)(xian)風(feng)(feng)(feng)(feng)險(xian)(xian)(xian)防(fang)控(kong)(kong)和服務(wu)水(shui)平(ping)。保(bao)(bao)(bao)險(xian)(xian)(xian)機構(gou)要不斷完(wan)善風(feng)(feng)(feng)(feng)險(xian)(xian)(xian)管控(kong)(kong)機制,積極開展風(feng)(feng)(feng)(feng)險(xian)(xian)(xian)管理,有(you)效(xiao)防(fang)范(fan)和控(kong)(kong)制風(feng)(feng)(feng)(feng)險(xian)(xian)(xian);要加強(qiang)對投保(bao)(bao)(bao)企業(ye)保(bao)(bao)(bao)前的風(feng)(feng)(feng)(feng)險(xian)(xian)(xian)調查,增強(qiang)保(bao)(bao)(bao)后風(feng)(feng)(feng)(feng)險(xian)(xian)(xian)跟蹤與風(feng)(feng)(feng)(feng)險(xian)(xian)(xian)預警能(neng)力(li),妥善處理合同糾紛(fen),提升(sheng)(sheng)賠付(fu)(fu)責任認(ren)定能(neng)力(li)。要切實(shi)發(fa)揮保(bao)(bao)(bao)險(xian)(xian)(xian)機構(gou)償付(fu)(fu)能(neng)力(li)強(qiang)、服務(wu)網絡廣的優勢(shi),強(qiang)化能(neng)力(li)建(jian)設,切實(shi)提升(sheng)(sheng)保(bao)(bao)(bao)險(xian)(xian)(xian)服務(wu)效(xiao)率,實(shi)現惠(hui)企、便(bian)民。

(四)助推建設(she)(she)工(gong)程(cheng)(cheng)領域誠信體系(xi)建設(she)(she)。保險(xian)機(ji)構在業務開展(zhan)過程(cheng)(cheng)中要實施(shi)差異化的費率(lv)體系(xi),建立溝(gou)通協調機(ji)制,積極探(tan)索將建設(she)(she)工(gong)程(cheng)(cheng)領域信用評價結(jie)果直接應用于工(gong)程(cheng)(cheng)擔保的具體措(cuo)施(shi),為信用狀況良好的企業提供便利(li),降低(di)保險(xian)費用、簡化投保程(cheng)(cheng)序(xu);將惡意索賠(pei)等嚴重失(shi)信企業納入(ru)建設(she)(she)工(gong)程(cheng)(cheng)“黑名單”管理,實施(shi)聯合(he)懲戒(jie),構建“一(yi)處(chu)失(shi)信,處(chu)處(chu)受制”的市(shi)場環(huan)境。

(五)不斷(duan)推(tui)進(jin)保險(xian)產(chan)品服(fu)務創(chuang)新。保險(xian)機(ji)構要積極(ji)開發(fa)適應行(xing)業改(gai)革發(fa)展(zhan)的(de)(de)新險(xian)種,推(tui)動建設(she)行(xing)業相關保險(xian)創(chuang)新突破,實(shi)現險(xian)種多(duo)元化,積極(ji)開展(zhan)勘(kan)察設(she)計(ji)責任(ren)險(xian)、住宅工程(cheng)質量交(jiao)付缺陷保險(xian)、安全生(sheng)產(chan)責任(ren)險(xian)等建設(she)工程(cheng)全產(chan)業鏈保險(xian),加(jia)快培養既(ji)懂保險(xian)業務又懂行(xing)業管理、適應跨界融合需要的(de)(de)復(fu)合型人才,促進(jin)保險(xian)業與(yu)其他行(xing)業的(de)(de)良性(xing)互動、健康發(fa)展(zhan)。

二、推動建設工程綜(zong)合保險市場有序(xu)競(jing)爭

(一)引入新(xin)的(de)(de)保險(xian)(xian)主體,實現適(shi)度市(shi)場競爭。由(you)市(shi)住建(jian)委牽頭,會同(tong)市(shi)發改(gai)委、市(shi)金(jin)融辦(ban)、市(shi)公共資(zi)源交管(guan)辦(ban)等部(bu)門采用公開招標的(de)(de)方式,確定兩家市(shi)級保險(xian)(xian)機(ji)構作為首(shou)(shou)席承(cheng)(cheng)(cheng)保人(ren),由(you)兩家首(shou)(shou)席承(cheng)(cheng)(cheng)保人(ren)各自(zi)牽頭聯(lian)合(he)其他保險(xian)(xian)機(ji)構組成(cheng)兩個(ge)共保體,共同(tong)負責寧波市(shi)行政區(qu)域內(nei)建(jian)設工(gong)程綜合(he)保險(xian)(xian)的(de)(de)市(shi)場調(diao)研、產品(pin)研發、承(cheng)(cheng)(cheng)保理賠以及險(xian)(xian)種推廣運行,進行公平展業。共保體成(cheng)員(yuan)(yuan)單位由(you)首(shou)(shou)席承(cheng)(cheng)(cheng)保人(ren)自(zi)主選擇,每個(ge)共保體成(cheng)員(yuan)(yuan)數量(liang)原(yuan)則(ze)上不超(chao)過5家。首(shou)(shou)席承(cheng)(cheng)(cheng)保人(ren)資(zi)質(zhi)有效(xiao)期為3年,到期后由(you)相關(guan)部(bu)門以公開招標的(de)(de)方式重新(xin)確定。

(二)保(bao)(bao)險機構要(yao)(yao)建(jian)(jian)(jian)立(li)溝通協(xie)調機制(zhi),避免無(wu)序(xu)競(jing)爭。參與保(bao)(bao)險機構要(yao)(yao)充(chong)分發揮各自(zi)優勢,提升保(bao)(bao)障(zhang)能力,完(wan)善(shan)服(fu)務(wu)機制(zhi),提高專(zhuan)業水平。要(yao)(yao)在監管部(bu)門的(de)(de)指(zhi)導下,遵(zun)守規范、科學、嚴(yan)謹的(de)(de)保(bao)(bao)險規則和服(fu)務(wu)標準(zhun)(zhun),制(zhi)定實施相對統一(yi)的(de)(de)保(bao)(bao)險條款(kuan)和保(bao)(bao)險費率,建(jian)(jian)(jian)立(li)統一(yi)的(de)(de)承保(bao)(bao)理賠服(fu)務(wu)標準(zhun)(zhun),以優質服(fu)務(wu)提升市場(chang)競(jing)爭力,嚴(yan)禁通過惡意降費等(deng)手(shou)段擾亂(luan)建(jian)(jian)(jian)設工程(cheng)保(bao)(bao)險市場(chang)秩(zhi)序(xu)。要(yao)(yao)分析寧波建(jian)(jian)(jian)設工程(cheng)市場(chang)不(bu)同區域的(de)(de)個(ge)性(xing)化差異,積(ji)極主動與當(dang)地相關部(bu)門聯系(xi),協(xie)調解決日常運營中的(de)(de)難點問題(ti)。

三、相關工作要求

(一(yi))各(ge)區縣(市(shi))、開發(fa)園區住房(fang)城鄉建設(she)、發(fa)展改革(ge)等行政(zheng)主管部門要(yao)充(chong)分認(ren)識推(tui)行建設(she)工程綜(zong)合(he)(he)保(bao)險的(de)重要(yao)意義,積極通過保(bao)險機制(zhi)減輕(qing)企(qi)業負擔(dan),促進行業改革(ge)發(fa)展。要(yao)堅持政(zheng)策性(xing)引導與市(shi)場化操作(zuo)相結合(he)(he),進一(yi)步提升建設(she)工程綜(zong)合(he)(he)保(bao)險在本區域的(de)覆蓋面。

各地(di)公共(gong)資源交易管理部門或工(gong)(gong)程招投(tou)標(biao)監管機構在(zai)實(shi)施工(gong)(gong)程招投(tou)標(biao)監管時,要(yao)督(du)促(cu)招標(biao)人(ren)在(zai)招標(biao)文件或工(gong)(gong)程合(he)同中明確所(suo)涉各類工(gong)(gong)程擔保可采用保險方式實(shi)施的(de)條款,確保建設工(gong)(gong)程綜(zong)合(he)保險落到實(shi)處。

各地(di)金融辦(ban)和銀行保(bao)險監管部門(men)要對建設工程綜合(he)保(bao)險的規范(fan)運行加(jia)強指導,強化(hua)對保(bao)險參與主體(ti)的監管。

(二)建(jian)設(she)工(gong)程綜合保險(xian)各首席承保人要(yao)及時(shi)總結經驗(yan),建(jian)立季度(du)報告、年(nian)度(du)總結等工(gong)作制度(du),加(jia)強風險(xian)防控,加(jia)快信息平臺建(jian)設(she),進一步提高服務質量(liang)。要(yao)調整工(gong)作思路和重點,從簡(jian)單為企業(ye)減負聚焦到民生服務和社會(hui)治理(li)上來。

(三)投(tou)保(bao)單位要切實履行主(zhu)體責任,規范(fan)市(shi)場(chang)行為,有效防(fang)范(fan)項目(mu)發(fa)生(sheng)質(zhi)量安全事故以及因拖欠農民工(gong)工(gong)資引發(fa)的群體事件,切實發(fa)揮建設(she)工(gong)程保(bao)險應有作用(yong)。投(tou)保(bao)單位提供虛假投(tou)保(bao)資料、虛假保(bao)函,以及保(bao)險合(he)同(tong)違(wei)約、事故索賠等情況將與其建筑市(shi)場(chang)信用(yong)評價掛鉤,情節嚴重的由行政主(zhu)管部門(men)根(gen)據相(xiang)關規定依(yi)法予以查處。
